مطالعۀ تطبیقی حق بر آب در خصوص زندانیان و افراد بازداشت‌شده در پرتو آرای دیوان‌های اروپایی و بین‌امریکایی حقوق بشر

چکیده

حق بر آب برای افراد بازداشت‌شده و زندانیان به‌عنوان افراد تحت مراقبت و محدودیت‌های شدید، نه‌تنها یک نیاز اساسی بلکه یک حق بشری است که باید در راستای حفظ کرامت انسانی و نیز سلامت این افراد، مورد توجه قرار گرفته، از نقض آن جلوگیری شود. به‌رسمیت شناختن حق بر آب به صورت یک حق مستقل، تأثیری بنیادین در جهت تأمین مطلوب این حق و تضمین آن ایفا می‌کند. این مقاله مبتنی بر روش توصیفی- تحلیلی به این سؤال پاسخ می‌دهد که حق بر آب در خصوص افراد محروم از آزادی در آرای دیوان‌های اروپایی و بین‌امریکایی حقوق بشر چگونه تبیین و تضمین شده است؟ نگارندگان نوشتار پیش رو نتیجه می‌گیرند که با توجه به عدم شناسایی صریح این حق در کنوانسیون‌های اروپایی و امریکایی حقوق بشر، این دو دیوان حق بر آب را نه به‌عنوان یک حق مستقل، بلکه به‌منزلۀ یکی از مصادیق کرامت انسانی قلمداد کرده‌‌اند و در پرتو قضایای متعددی ازجمله قضیۀ ویتکوفسکی علیه اوکراین در دیوان اروپایی حقوق بشر و قضیۀ بیسون و دیگران علیه ترینیداد و توباگو در دیوان بین‌امریکایی حقوق بشر، نقض حق بر آب را به‌عنوان نقض کرامت انسانی شناسایی کرده‌اند. این دو دیوان، به‌منظور تبیین دسترسی به آب سالم و کافی، نقض این حق را از منظر حقوقی به‌عنوان نقض تعهدات دولت‌های عضو در قبال صیانت از کرامت انسانی یادشده در مادۀ 3 کنوانسیون اروپایی حقوق بشر و بند دوم مادۀ 5 کنوانسیون امریکایی حقوق بشر تلقی کرده‌اند. اما در موارد متعددی مانند قضیۀ والاشیناس علیه لیتوانی در دیوان اروپایی حقوق بشر، قرار گرفتن حق بر آب ذیل سایر حقوق سبب شده است که در اثر عدم احراز نقض مادۀ 3 کنوانسیون از سوی این دیوان، تضمین اجرای این حق برای زندانیان محقق نشود.
