مفهوم بحران قانون اساسی (مطالعۀ تطبیقی)

چکیده

در نظریۀ حقوق اساسی نظریه‌ها و مفاهیم متعددی در خصوص قانون اساسی شکل گرفته است. یکی از این مفاهیم، بحران قانون اساسی است. در هر کشوری که دارای نظام حقوق اساسی است ممکن است در لحظات خاصی یک مشکل سیاسی و حقوقی رخ دهد که نظام حقوق اساسی قادر به پاسخگویی به آن و رفع آن مشکل نباشد. نگارندۀ این مقاله با روش توصیفی- تحلیلی و با استفاده از مطالعۀ تطبیقی به‌دنبال پاسخ به این پرسش است که مفهوم بحران قانون اساسی به چه معنایی است و چگونه می‌توان آن را شناسایی کرد. در بحران قانون اساسی اصول مندرج در قانون اساسی و نظام حقوقی کشور قادر به حل یک مشکل یا تعارض جدی در عملکرد دولت نیست. بحران اساسی به انواع مختلفی تقسیم می‌شود که در این مقاله بررسی شده‌اند. همچنین بحران قانون اساسی با مفاهیمی مانند فرسایش قانون اساسی، پوسیدگی قانون اساسی و وضعیت اضطراری نسبت نزدیکی دارد که در این مقاله کوشش شده است مورد مطالعه قرار گیرند. ازآنجا که نظام‌های سیاسی و حقوقی مختلفی در جهان وجود دارد، مصادیق بحران اساسی در نظام‌های مختلف نیز در مقالۀ حاضر مورد توجه قرار گرفته است.
