Abstract

The use of artificial intelligence by banks has brought about profound transformations in the field of banking data processing. In traditional banking, data processing is generally carried out based on established principles, and necessary safeguards are implemented to protect the rights of data subjects. The prevailing literature in this area has predominantly focused on analyzing the concepts and instances of personal data, as well as the governing principles applicable thereto. This article, adopting a descriptive-analytical method and relying on library-based sources, addresses the question of what impact the emergence of artificial intelligence has on the principles governing the processing of personal banking data and on customers’ rights, and whether Iranian law provides comprehensive and clear regulations in this regard. The findings of the study indicate that artificial intelligence poses challenges and obstacles, on the one hand, to principles such as informed consent, transparency of processing, data accuracy and currency, and data confidentiality, and, on the other hand, to customers’ rights such as the right to data portability, the right to restriction of processing, the right to erasure (the “right to be forgotten”), and the right to object to automated decision-making. The results further suggest that the enactment of comprehensive data protection laws and regulations, taking into account the specific characteristics of artificial intelligence, along with the designation of clearly defined types of artificial intelligence for use by each institution within a specific regulatory framework, can to a large extent prevent violations of the principles governing data processing and the rights of customers.
