Analyzing the Areas of Public Participation in Legislation in the Context of the Constitution of the Republic of Iran and its Challenges, and Presenting a Desirable Model in Light of a Comparative Study

Abstract

Public participation in legislative projects, as one of the basic indicators of political and legal development, plays a determining role in increasing laws and public trust in the political system. The main issue of this research is that despite legal provisions for this participation in the Constitution of the Islamic Republic of Iran, numerous legal, structural, and cultural challenges and confrontations prevent its full realization. Accordingly, what is social research as a desirable model for promoting public participation in constitutional projects of the Islamic Republic of Iran, considering medical experiences, and how can the law be hidden? This article, using a descriptive-analytical method and comparative studies and analysis, first explains the relevant concepts and theories, then discusses them in the Constitution of Iran. The research findings show that the main differences in the three areas of legal-structural, cultural-political, and executive can be identified and the experience of some sources in utilizing new mechanisms of public participation can be a standard in designing a suitable model for Iran. Finally, the proposed model is presented with a decision on legal reforms, strengthening participatory institutions, and promoting the political culture of citizens, which can lay the groundwork for the realization and role of the people in the legislative process.
