Investigation on the Rights of People with Disabilities from the Perspective of Domestic and International Law with Emphasis on the Principles of Equality, Access, and Accessibility

Abstract

This research employs a descriptive-comparative method to examine the adequacy of Iran's domestic laws concerning the rights of persons with disabilities. Despite the enactment of laws such as the Comprehensive Law on the Support of Persons with Disabilities (2004) and the newer law (2017), as well as Iran's accession to the International Convention on the Rights of Persons with Disabilities, significant protective gaps persist in both legal texts and implementation processes. The central question is whether the approach of these documents toward disability is "medical-based" or "human rights-based," and what are the strengths and weaknesses of these laws? The findings reveal that the Convention, by adopting a human rights-based approach grounded in inherent dignity and equality, has replaced the former medical-based perspective. However, Iran's domestic laws, particularly the 2004 law, have failed to adequately incorporate fundamental principles such as "equality" and "access." Although the 2017 law has taken steps to address these shortcomings, the primary deficiency remains the lack of "effective and comprehensive legal enforcement mechanisms" for violations of the rights of persons with disabilities and for claiming compensation from governments, institutions, or individuals. This weakness, which may be influenced by the primacy of state sovereignty in international law, practically makes it difficult for persons with disabilities to realize their rights and marginalizes them.
