The International Jurisdiction Rules and their Relationship with the Conflict of Law Rules: A Comparative Study in Egyptian and Iranian Law

Abstract

The international jurisdiction is one of the main subjects of private international law. The rules of international jurisdiction determine the jurisdiction of national courts on deciding private international disputes. There is no unanimous agreement between private international law scholars about the main characteristics of international jurisdiction rules. Additionally, there is no uniform international approach to accepting criteria for laying down the international jurisdiction rules and every country follows its own policy. The current study with a descriptive-analytical method and a comparative approach aims to explain the main characteristics of the international jurisdiction rules and to resolve any controversies regarding them. The study also aims to examine the most important criteria for laying down the international jurisdiction rules and the attitude of Egyptian and Iranian law towards these criteria. Furthermore, in this regard, the relationship between the international jurisdiction rules and conflict of law rules is considerable. Therefore, the study also points to examining the relationship between these rules and the possibility of their influence on each other.
