An Analysis of the Concept of Investment in International Investment Law with Emphasis on Intellectual Property (A Comparative Study of the Universal Approach and Iran)

Abstract

The concept of investment and its scope has a specific status in the legal system governed by investment agreements. Therefore, one of the aspects of the role and status of intellectual property in international investment law, and perhaps the most important, is the inclusion of the concept of investment and the protective scope. This does not same status in historic evolutions, therefore history of investment agreements and accordingly historic evolution of the concept of investment and its inclusion on intellectual property should be studied in two main periods, before 1960 and the period after this date, independently of each other and then analyzed the concept of investment in international investment law based on it, with emphasis on intellectual properties. Based on current research results, globally, as to the concept of investment and protection of intellectual property rights, a broad approach is governed in international investment agreements, which are based on the pervasive effect of agreements arising from their protective clauses, in particular, most favored nation clause, has gradually turned into a universal rule and even promote reasonable protective standards in the field of the concept of investment and intellectual property rights. Therefore reform of developing countries’s adopted procedures, specifically WTO members is necessary. Iran’s adopted procedure in bilateral investment agreements is the adoption of a broad approach to the concept of investment and protection of intellectual property. Do not overdo it and status, manner, and scope of protection of investment and intellectual property rights can’t be the same for all countries and all the investment fields; Especially regarding countries like Iran, which do not accept even international requirements of TRIPs agreement.
