Conflict of Interest as the Origin of Some Crimes in Iranian Law with Emphasis on Legislative Experiences in Canada

Abstract

Analyzing issues from the point of view of criminology and predicting the occurrence of crimes affecting the society in the future requires that the legislative experiences of other nations be studied in this regard. Among these issues, as one of the possible causes of crimes in the future, is the issue of conflict of interests, which has not been properly organized in Iran. In this article, with descriptive and analytical approaches, we seek to find out the question whether the violation-causing and criminal-causing bases of the conflict of interest in Iran in the field of power holders can be identified and acted upon according to the approaches of other countries. In response to this question, it can be said that by looking at the experience of controlling the conflict of interest in the legislation of Canada, which has been desired by Canadian legislators by increasing public trust as a social capital as a result of the separation of private interests from the public, and its internal and legal localization. It is possible to reduce some of the bases of violations and crimes in the field of conflict of interest.
