Despite this issue, the competence or incompetence of the regulation-making by the Guardian Council is one of the most significant matters in Iran's constitutional law. This article seeks to investigate the opponents’ and proponents’ positions on the Guardian Council's regulation-making power and deal with whether the Guardian Council has the regulation-making power. Some of the reasons for verifying this power include recognition of regulation-making power by ordinary laws, competence of similar constitutional institutions for regulation-making, recognition of regulation-making by interpreter of the constitution, regulation-making power to ensure the independence of the Guardian Council and regulation-making power based on constitutional custom. Through the analysis of these reasons and the responses of the opponents of Guardian Council's power, the research question has been answered. The findings of the present research study suggest that despite the necessity of recognizing the regulation-making competence of the Guardian Council (such that it can desirably perform its duties and powers), this competence cannot be defended in light of public law principles and the Constitution of the Islamic Republic of Iran.<br /><br /> قانون اساسی دربارۀ صلاحیت مقررات‌گذاری شورای نگهبان ساکت است، ولی این نهاد اساسی راساً یا از طریق مأموریت قانون‌گذار عادی به مقررات‌گذاری مبادرت می‌کند. با وجود این، صلاحیت یا عدم صلاحیت مقررات‌گذاری شورای نگهبان از مسائل مهم در حقوق اساسی جمهوری اسلامی ایران است. نویسندگان این مقاله تلاش می‌کنند تا دلایل موافقان و مخالفان صلاحیت مقررات‌گذاری شورای نگهبان را بررسی کنند و درنهایت به این پرسش پاسخ دهند که آیا شورای نگهبان دارای صلاحیت مقررات‌گذاری است؟ برخی از دلایل قابل ارائه در مقام تأیید صلاحیت مقررات‌گذاری شورای نگهبان عبارت‌اند از: شناسایی صلاحیت مقررات‌گذاری از طریق قوانین، صلاحیت نهادهای اساسی مشابه برای مقررات‌گذاری، شناسایی صلاحیت مقررات‌گذاری از سوی مفسر قانون اساسی، صلاحیت مقررات‌گذاری به‌منظور تأمین استقلال شورای نگهبان، و صلاحیت مقررات‌گذاری به استناد عرف اساسی. با تحلیل و بررسی دلایل یادشده و پاسخ‌های مخالفانِ صلاحیت شورای نگهبان، پاسخ نهایی به پرسش تحقیق مشخص شد. نتیجۀ تحقیق این است که با وجود ضرورت شناسایی صلاحیت مقررات‌گذاری برای شورای نگهبان به‌منظور انجام مطلوب وظایف و اختیارات خویش، چنین صلاحیتی برای شورا با نظر به اصول حقوق عمومی و قانون اساسی جمهوری اسلامی ایران اثبات نمی‌شود. https://law.tabrizu.ac.ir/article_7739_100af2e245228e1403e2e7c97306a591.pdf
