Naturally, one of<br />the very important factors in economic development is soliciting funds<br />of investment traders and investors in order to support the manufacturing<br />and jobs. In fact, the more the amount of investment in the country is, the<br />more the amount of production and employment as well as the industrial<br />and scientific development will be. However, increased investment also<br />depends on investors' confidence and unwavering support of them<br />against imminent harm of others. Hence, motivation for investment and<br />economic activities among businessmen and economic activists inside<br />and outside the country will be increased and the hopes for economic<br />growth will improve. Obviously, this requires different policies in all<br />areas including the legal and judicial area. In the legal realm, it must be<br />ensured that the investors' rights are preserved against competitors and<br />those who seek to violate professional rules and all those who enter in<br />economic activities have enough confidence that the norm-breakers in<br />this area will be prosecuted. This can be achieved by criminalization of<br />some behaviors in the field of economic activities. This paper has used<br />an analytical-critical method to study the foundations of criminalization<br />in the field of economic activities. We have also tried to analyze the<br />procedure and punishment for perpetrators of economic crimes. رونق اقتصادی و رفع موانع پیشرفت و اقتدار هر کشوری در گرو حمایت از فعالیت‌های اقتصادی صحیح و مولد است که بدون آن ممکن است سایر پیشرفت‌ها تحت‌الشعاع ضعف‌های اقتصادی قرار گرفته، جایگاه سیاسی و اجتماعی یک دولت در دنیای امروز متزلزل گردد. طبیعتاً یکی از عوامل بسیار مهم در پیشرفت اقتصادی جلب سرمایه‌های تجار و سرمایه‌گذاران برای حمایت از تولید و صنعت و اشتغال‌زایی است. درواقع، هرچه میزان سرمایه‌گذاری در کشور بیشتر باشد، به همان نسبت میزان تولید و اشتغال و پیشرفت صنعتی و علمی نیز بیشتر خواهد بود. با وجود این، افزایش سرمایه‌گذاری خود در گرو جلب اعتماد سرمایه‌گذاران و حمایت بی‌دریغ از آنان در برابر آسیب‌های احتمالی است تا بدین‌سان انگیزة سرمایه‌گذاری و فعالیت اقتصادی در میان تجار و فعالان اقتصادی داخل و خارج کشور افزایش یافته، امیدها برای رشد اقتصادی کشور فزونی یابد. بدیهی است، این امر مهم نیازمند اتخاذ سیاست‌های گوناگون در همة حوزه‌ها ازجمله در حوزة حقوقی و قضایی است. در قلمرو حقوقی و قضایی باید ترتیبی اندیشیده شود که حقوق سرمایه‌گذاران در برابر سایر رقبا و کسانی که در پی نقض قواعد حرفه‌ای هستند محفوظ مانده، همة افرادی که وارد فعالیت اقتصادی می‌شوند نسبت به تعقیب کیفری هنجارشکنان این حوزه اطمینان کافی داشته باشند. این مسئله از طریق جرم‌انگاری برخی رفتارها در عرصة فعالیت‌های اقتصادی قابل تحقق است که در این مقاله به بررسی این موضوع پرداخته‌ایم. روش تحقیق در این مقاله، روش تحلیلی- انتقادی است که بر اساس آن ضمن مطالعة مبانی جرم‌انگاری در حوزة فعالیت‌های اقتصادی، سعی شده است آیین رسیدگی و مجازات مرتکبان جرائم اقتصادی نیز تحلیل و بررسی شود. https://law.tabrizu.ac.ir/article_5966_a23176fdc787ff5841eb9f9784a71c36.pdf
