It has begun to build numerous dams and hydroelectric power plants on the Tigris and the Euphrates River since 1977. Considering that the implementation of this project has had and will have numerous environmental, social and economic impacts on the surrounding countries i.e., Iraq, Syria and Iran and according to experts, Turkey has not performed the environmental impact assessment process of this project correctly, the question is whether Turkey has a binding international obligation from the international law perspective to implement its commitment to environmental impact assessment. The results of this article show that, given to the international documents and procedures, today's commitment to conduct environmental impact assessment in projects that have the potential to create significant transboundary damage has been known as a mandatory customary commitment and it is necessary for all countries. Thus, Turkey was also obliged to carry out this task in the implementation of the Gap project, which by failing to comply, it has international responsibility. کشور ترکیه به‌عنوان کشور بالادستی در حوضۀ رود دجله و فرات از سال 1936 طرحی به نام آناتولی جنوب شرقی (گاپ) را پایه‌ریزی کرد که در ضمن آن از سال 1977 احداث سد‌ها و نیروگاه‌های برق‌آبی متعددی را بر روی رودخانۀ دجله و فرات آغاز نمود. با توجه به اینکه اجرای این پروژه بر کشورهای اطراف یعنی عراق، سوریه و ایران آثار منفی زیست‌محیطی، اجتماعی و اقتصادی متعددی برجای گذاشته و خواهد گذاشت و به اعتقاد کارشناسان، کشور ترکیه فرایند ارزیابی آثار زیست‌محیطی این طرح را به‌درستی انجام نداده است، پرسش این است که آیا از دیدگاه حقوق بین‌الملل کشور ترکیه تعهدی الزام‌آور به ارزیابی آثار زیست‌محیطی دارد؟ نتایج حاصل از این نوشتار بر اساس تحلیل اسناد و رویۀ قضایی بین‌المللی مؤید آن است که امروزه تعهد به اجرای ارزیابی آثار زیست‌محیطی در پروژه‌هایی که پتانسیل ایجاد آسیب مهم فرامرزی دارند، به‌عنوان یک تعهد عرفی الزام‌آور شناخته شده و برای همۀ کشورها لازم‌الرعایه است. به این ترتیب، کشور ترکیه نیز در احداث پروژۀ گاپ موظف به اجرای این تعهد بوده است که عدم رعایت آن برای این کشور مسئولیت بین‌المللی به‌دنبال خواهد داشت. https://law.tabrizu.ac.ir/article_12956_db6597e44176335785b46604152c126d.pdf
