In this situation, due to the defeat of defenseless criminal policies in the fight against ideological terrorism, it is necessary to focus the attention of the criminal policy makers on the cause of the emergence of terrorism (that is, extremism in the form of excommunication). In this regard, those extremists who are susceptible to excommunication can be restrained through non-refoulement, and they control the other, who have stumbled on the brink of victimization, through the rebellion and the threat of punishment. Therefore, it is necessary to transcend this phenomenon from the measures of the philosophical basis of criminality in order to convince the legislature to legally ban excommunication as the main driving force of contemporary terrorism. Therefore, the present paper initiates a non-refoulement prevention to prevent excommunication. Then it justifies adherence of excommunication on the basis of the philosophical principles of criminality, to prevent the transformation of active ex-communication forces into terrorist elements تکفیر در اصطلاح یعنی کافر شمردن. این مفهوم در معنای افراطیِ آن با مهدورالدم بودنِ تکفیرشده ملازم است. تلازمی که درعمل به معضل جهانی تروریسم ایدئولوژیک مبدل شده و معادلات جرم‌شناسانه و پیشگیرانۀ ملی و بین‌المللی در مبارزه با این پدیده را به‌هم زده است. در این وضعیت با توجه به شکست سیاست‌های کیفری توان‌گیر و سزاگرایانه در مبارزه با تروریسم ایدئولوژیک، ضروری است توجه سیاست‌گذاران کیفری را به مقابله با علت به‌وجود آمدنِ تروریسم (یعنی همان افراطی‌گری در قالبِ تکفیر) معطوف کرد. در این راستا، آن دسته از افراطیونِ مستعدّ تکفیر را می‌توان با شیوه‌های غیرکیفری مهار نمود و دستة دیگر را که دست به تکفیر زده و در آستانة بزهکاری قرار گرفته‌اند از طریق کیفرگذاری و تهدید به مجازات کنترل کرد. بنابراین، لازم است این پدیده را از سنجه‌های مبانی فلسفیِ جرم‌انگاری عبور داده تا از این راه بتوان قانون‌گذار را در ممنوعیتِ قانونیِ تکفیر به‌عنوان محرک اصلی تروریسم معاصر قانع کرد. لذا مقالۀ حاضر در ابتدا متعرِض پیشگیری کنشی رشدمدار برای جلوگیری از تکفیر است و سپس به توجیه تجریمِ تکفیر بر اساس مبانی فلسفیِ جرم‌انگاری برای پیشگیری از تبدیل نیروهای فعال تکفیری به عوامل تروریستی خواهد پرداخت. https://law.tabrizu.ac.ir/article_11305_decf8e343b0a96d030fd8012608ca38d.pdf
