In fact, not only will the spiritual and religious rights of citizens not secured, but also they will be disrupted; this is the result of irreparable spiritual and cultural losses. In addition, while in some cases, the hypothesis of the responsibility of public social institutions has been accepted, in other very important cases, such as culture, this hypothesis requires the production and explanation of research theories.  In other words, when a government takes over the system of society and nation, any misconduct in social and legal affairs at a macro level is due to its lack of deception, whether it results from improper regulation or non-regulation and non-fulfillment. This descriptive-analytic research attempts to outline the jurisprudential and legal issues of the state's responsibility, such as the rule of law, the theory of fault and the guarantee of the right. Considering the scope of civil responsibility of state in cultural affairs and mechanisms of compensating moral losses, this research attempts to base the theory on a regular and unitary model and introduce relevant challenges for future research. اگر نهادهای ‌فرهنگی و اجتماعی نتوانند در جهت تأمین حقوق ‌فرهنگی به‌درستی ایفای تعهد نمایند، هنجارهای اجتماعی و ارزش‌های فرهنگی بیش از پیش تحت تأثیر قرار گرفته، تغییرات گسترده‌ای در سبک زندگی سایر اشخاصِ اثرگذار جامعه ایجاد خواهد شد. درواقع نه‌تنها حقوق معنوی و دینی شهروندان تأمین نمی‌شود، بلکه تضییع هم می‌گردد. همین امر مسبب ایراد ضررهای‌ معنوی و فرهنگی غیرقابل جبرانی است. از سوی دیگر، با اینکه در برخی موارد، فرضیۀ مسئولیت نهادهای اجتماعی دولتی پذیرفته شده، همچنان در موضوعات بسیار مهم دیگری همچون فرهنگ، این فرضیه نیازمند تولید و تبیین نظریه‌های پژوهشی است. به بیان دیگر، وقتی حکومت یا دولتی نظام جامعه و ملتی را به‌دست می‌گیرد، هرگونه سوء جریان در روابط اجتماعی و حقوقی در سطح کلان، ناشی از عدم تدبیر اوست؛ خواه ناشی از وضع مقررات نامطلوب باشد و خواه ناشی از عدم وضع مقررات و انجام ندادن پیش‌بینی‌های لازم. در پژوهش حاضر با روش توصیفی- تحلیلی تلاش می‌شود مبانی‌ فقهی و حقوقی مسئولیت ‌مدنی دولت از قبیل قاعدۀ لاضرر، نظریۀ‌ فرض تقصیر و تضمین حق مدلل شود. با توجه به گسترۀ چگونگی مسئولیت مدنی دولت در امور فرهنگی و نحوۀ جبران ضررهای معنوی، این پژوهش سعی دارد مبانی این نظریه را در قالبی منظم و واحد درآورد و چالش‌های مرتبط را برای انجام پژوهش‌های بعدی معرفی نماید. https://law.tabrizu.ac.ir/article_11293_e8f762e79c010178f58d1038e7653c44.pdf
