Pursuant to Article 1 of the Building Pre-Sale Code and other articles of this Code, the pre-sale contract, as a specific contract, along with other contracts, has the following characteristics: ownership, consent, exchange, necessary and exclusive. In Article 20 of the Building Pre-Sale Code, the legislator, while determining the competent authority for resolving disputes arising from the pre-sale contract and deeming it necessary to resolve the disputes of this contract through arbitration, also limits the authority of that authority for interpretation, interpretation and execution. The provisions of the contract have been determined. On the other hand, the same Code stipulates requirements for the parties to the contract, such as formally concluding the contract, appointing arbitrators and including the provision of Article 20 of the Code in the contract. That legislator's silence regarding the guarantee of non-compliance with the above-mentioned cases in arbitrating the subject matter of the Code has caused a dispute in the judicial procedure. Also, the lack of will of the parties in referring the principle of dispute to arbitration, raises suspicion that the true title of arbitration does not apply to the dispute resolution authority subject to Article 20 of the Code. The present article seeks to deal with the guarantee of the performance of the first forms along with justifying and explaining the nature of the dispute resolution authority of pre-sale contracts.}, keywords = {Pre-sale contract,Arbitration,Compulsory arbitration,Pre-sale contract descriptions,Gradual acquisition}, title_fa = {تأملی بر نحوۀ حل و فصل اختلافات ناشی از قرارداد پیش‌فروش و قلمرو آن}, abstract_fa = {با انعقاد قرارداد پیش‌فروش، بخشــى از عرصه یا زمین به نسبتِ سهم خریدارى‌شــده به پیش‌خریدار منتقل مى‌شــود.نظر به مادۀ 1 قانون پیش‌فروش ساختمان و دیگر مواد این قانون، قرارداد پیش‌فروش به‌عنوان عقدی معین در کنار سایر عقود، واجد اوصافی از قبیل تملیکی، رضایی، معوض، لازم و منجز است.قانون‌گذار در مادۀ 20 قانون پیش‌فروش ساختمان، ضمن تعیین مرجع صالح برای حل و فصل اختلافـات ناشـی از قـرارداد پـیش‌فـروش و الزامی دانستن حل و فصل اختلافات این قرارداد از طریق داوری، محدودة صلاحیت آن مرجع را نیز صرفاً تعبیـر، تفسـیر و اجـرای مفـاد قـرارداد تعیین کرده است. از طرف دیگر، در همین قانون، الزاماتی برای طرفین قرارداد ازجمله تنظیم قرارداد به صورت رسمی، تعیین داوران و درج حکم مادۀ 20 قانون در قرارداد پیش‌بینی شده است که سکوت قانون‌گذار در خصوص ضمانت اجرای عدم رعایت موارد یادشده بر داوری موضوع قانون سبب ایجاد اختلاف در رویۀ قضایی گردیده است. همچنین نبود ارادۀ طرفین در ارجاع اصل اختلاف به داوری موجب ایجاد شبهه مبنی بر عدم صدق عنوان حقیقی داوری بر مرجع حل اختلاف موضوع مادۀ 20 قانون می‌‌شود. نگارندگان مقالۀ حاضر در صدد پاسخگویی به ضمانت اجراهای اشکال اول در کنار توجیه و تبیین ماهیت مرجع حل اختلاف قراردادهای پیش‌فروش هستند.}, keywords_fa = {اوصاف قرارداد پیش‌فروش,تملیک تدریجی,داوری,داوری اجباری,قرارداد پیشفروش}, url = {https://law.tabrizu.ac.ir/article_12958.html}, eprint = {https://law.tabrizu.ac.ir/article_12958_fddfae70caeeab4bf5964e252df69edd.pdf} }
